U.S. V. REESE (1876)

This Reconstruction-era Supreme Court case addressed the Fifteenth Amendment and voting rights. The case arose from litigation surrounding the Enforcement Act of 1870 passed by Congress. A Kentucky clerk had denied an African American man’s request to register to vote, in violation of Section 3 of the law. In a 7–2 decision the court under Chief Justice Morrison Waite found that section of the law to be invalid since it did not explicitly repeat the language in the Fifteenth Amendment prohibiting male suffrage on the basis of race, color, or condition of previous servitude. The ruling was a watershed in state and local governments’ adoption of poll taxes, grandfather clauses, literacy tests, and other mechanisms aimed at precluding African Americans from exercising the vote.
